What a title check involves, what it can find, and which findings should end a transaction.
Title verification establishes that a seller lawfully owns a property and can transfer it free of competing claims. It involves tracing every ownership transfer through the chain of title, obtaining an encumbrance certificate from the sub-registrar to reveal registered charges, checking revenue records for land, and confirming approvals for built property. It should be completed before a token advance is paid, not after.
A clear or marketable title means the seller owns the property outright, the ownership can be traced through documented transfers, no other party has a competing claim, and nothing is registered against the property that would restrict its transfer.
The phrase gets used loosely by sellers. Verification is how you establish whether it is true.
Start from the current sale deed and work backwards through every prior transfer. Each link should be a registered document, and each transfer should be explicable — a sale, an inheritance, a gift, a partition.
The conventional standard is thirty years, which is long enough that most claims would have surfaced. What matters more than the exact period is that there is no gap. An undocumented transfer in the middle of the chain means someone conveyed the property without a record establishing that they had the right to.
The encumbrance certificate lists registered transactions affecting the property over a stated period. What you are looking for is anything still subsisting: a mortgage that was never released, a lien, an attachment, or a registered agreement in favour of another buyer.
A common finding is an old home loan charge that was fully repaid but never formally released. This is usually curable — the lender issues a release — but it must be resolved before registration, not afterwards.
For land, the 7/12 extract shows the current holder, area, and the mutation entries recording every change in ownership or rights. Read the mutation history rather than only the current entry — entries recording tenancy rights, loans or restrictions carry consequences that survive a sale.
Also verify the NA order and what use it actually permits, and confirm the zoning position under the applicable development plan.
Most title issues fall into a small number of recognisable categories, and it is worth knowing which are administrative and which are structural.
Walk away when ownership is genuinely disputed, when a break in the chain cannot be reconstructed, when a co-owner refuses to release their interest, or when the structure was built in a way that cannot be regularised.
The pressure at this point is usually to proceed anyway, because time and emotional investment have accumulated. That pressure is exactly why verification should happen before the token advance rather than after.

Treat that as a significant warning. A seller with clean title has no reason to withhold title documents from a serious buyer. At minimum, structure the token so it is explicitly refundable if verification reveals a defect, and get that in writing.
